Terms of Service

These Terms govern all bookings, artist representation, and services provided by Creative Events Promoter. Please read carefully before engaging our services.

1. Agreement to Terms

By accessing the website creativeeventsagency.com or engaging the services of Creative Events Promoter ("CEP Agency", "we", "us", "our"), you confirm that you have read, understood, and agree to be bound by these Terms of Service and all applicable Dutch laws and regulations.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you must not use our services.

2. Services Provided

CEP Agency is a professional artist booking and promotion agency based in Amsterdam, the Netherlands. Our services include:

  • Artist representation, booking coordination, and contract negotiation
  • International touring support and logistics
  • Event promotion, marketing, and press coordination
  • Radio & media placement via RadioDJSound and partner networks
  • Brand partnership facilitation between artists and commercial clients
  • Artist development, EPK creation, and digital presence management
  • Promoter services and venue consultation

All services are subject to availability and the specific terms agreed upon in individual booking contracts or service agreements.

3. Booking Process & Contracts

3.1 Inquiries & Quotes

All booking inquiries submitted via our website, email, or direct contact are treated as expressions of interest only. Quotes and fee estimates provided are indicative and subject to change based on event specifics, travel requirements, technical riders, and artist availability at the time of confirmation.

3.2 Booking Confirmation

A booking is only confirmed when all of the following conditions are met:

  • A written booking agreement or contract is signed by all parties
  • The required deposit payment has been received and cleared
  • Artist availability has been confirmed in writing by CEP Agency
  • Technical rider and hospitality requirements have been agreed upon

Verbal agreements, email exchanges, or social media communications do not constitute a confirmed booking unless followed by a signed written contract.

3.3 Contract Terms

Each confirmed booking is governed by a specific booking contract issued by CEP Agency. That contract takes precedence over these general Terms in the event of any conflict. Contracts will specify: artist fee, performance duration, set time, technical requirements, hospitality rider, travel and accommodation obligations, and any exclusivity clauses.

4. Payment Terms

Unless otherwise specified in the booking contract, the following standard payment terms apply:

All fees are quoted in Euros (EUR) unless otherwise agreed. Bank transfer charges, international wire fees, and currency conversion costs are the responsibility of the client. CEP Agency accepts payment via bank transfer (IBAN), and other methods as agreed in writing.

Additional costs including but not limited to flights, accommodation, ground transport, visa fees, and backline equipment will be invoiced separately and must be settled in accordance with the booking contract.

5. Cancellations & Refunds

5.1 Client Cancellations

All cancellations must be submitted in writing to [email protected]. The following cancellation policy applies:

5.2 Artist Cancellations

In the rare event that an artist must cancel due to illness, injury, bereavement, or circumstances genuinely beyond their control, CEP Agency will make reasonable efforts to provide a suitable replacement artist of comparable calibre. If no suitable replacement is available, a full refund of all payments received will be issued within 14 business days.

5.3 Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to: natural disasters, government restrictions, pandemic measures, war, civil unrest, or venue closure. In such cases, both parties will negotiate in good faith to reschedule or reach a fair resolution.

6. Event Requirements

The client (promoter/venue) is responsible for providing the following unless otherwise agreed in the booking contract:

  • Professional-grade sound system and DJ equipment as specified in the technical rider
  • Safe, clean, and professional working environment for the artist and their team
  • Agreed accommodation (minimum 3-star hotel) and ground transportation
  • All necessary permits, licences, and insurance for the event
  • Adequate security and crowd management personnel
  • Hospitality rider as specified (meals, beverages, dressing room)
  • Timely soundcheck access as agreed in the contract

Failure to meet these requirements may result in the artist declining to perform without penalty or refund obligation on the part of CEP Agency or the artist.

7. Artist Representation

CEP Agency acts as the exclusive or non-exclusive booking representative for artists in our roster, as specified in individual artist management agreements. Our representation covers:

  • Negotiation of booking fees and contract terms on behalf of the artist
  • Coordination of travel, logistics, and technical requirements
  • Promotion and marketing of the artist within agreed territories
  • Liaison between artist, promoter, and venue

Artists retain full creative control over their performances within the scope of the agreed event requirements. CEP Agency does not guarantee specific performance outcomes, crowd sizes, or commercial results.

Any direct approach to CEP Agency artists for bookings, bypassing the agency, is a breach of these Terms and may result in legal action for loss of commission.

8. Intellectual Property

All content on this website — including but not limited to text, graphics, logos, artist photos, audio samples, and video content — is the property of Creative Events Promoter, our artists, or licensed third parties, and is protected under Dutch and international copyright and trademark law.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on this site without prior written permission from CEP Agency. Press and media enquiries regarding use of artist images or promotional materials should be directed to [email protected].

Recording, filming, or live-streaming of artist performances requires explicit written consent from CEP Agency and the artist prior to the event.

9. Liability & Indemnification

9.1 Limitation of Liability

To the maximum extent permitted by Dutch law, CEP Agency's total liability to any client or third party shall not exceed the total fees paid to CEP Agency for the specific booking giving rise to the claim. CEP Agency is not liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or business opportunity
  • Events beyond our reasonable control (force majeure)
  • Technical failures at venues or third-party equipment
  • Actions or omissions of third-party service providers

9.2 Indemnification

The client agrees to indemnify, defend, and hold harmless CEP Agency, its directors, employees, artists, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: the client's event, breach of these Terms, violation of any third-party rights, or any negligent or unlawful act by the client or their staff.

10. Confidentiality

Both parties agree to keep strictly confidential all non-public information exchanged during the booking process and the term of any agreement. This includes but is not limited to: artist fees and financial terms, availability schedules, personal contact details of artists, unreleased music or promotional materials, and internal business information.

This confidentiality obligation survives the termination of any booking agreement and remains in force for a period of three (3) years thereafter, unless disclosure is required by applicable law or court order.

11. GDPR & Data Protection

CEP Agency processes personal data in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and the Dutch Implementation Act (UAVG). Personal data submitted through our website or in the course of booking negotiations is processed solely for the purpose of delivering our services and communicating with you.

12. Dispute Resolution

In the event of any dispute arising from or in connection with these Terms or any booking agreement, the parties agree to the following resolution process:

Good Faith Negotiation

The parties will first attempt to resolve the dispute through direct, good-faith negotiation within 30 days of written notice of the dispute.

Mediation

If negotiation fails, the parties agree to submit the dispute to a mutually agreed mediator in Amsterdam before initiating formal legal proceedings.

Legal Proceedings

If mediation is unsuccessful, disputes shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands.

13. Governing Law

These Terms of Service and any booking agreements entered into with CEP Agency are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Any legal proceedings shall be conducted exclusively before the competent courts of Amsterdam, the Netherlands, unless otherwise agreed in writing.
